On April 21, 2025, the National Institutes for Health (NIH) released a notice announcing a new Civil Rights term and condition that "modifies current terms and conditions for all NIH grants, cooperative agreements, and other transaction (OT) awards" and "applies prospectively to new, renewal, supplement, or continuation awards issued on or after" the notice date. 

The new term supercedes the "Civil Rights Protections" section of the NIH Grants and Policy Statement (GPS) and negotiated terms of OT awards. Specifically, the section is updated in line with recent Executive Orders targeting DEI (diversity, equity, and inclusion) or DEIA (diversity, equity, inclusion, and accessibility) efforts throughout the federal government, including recipients of federal funds. 

The Association of American Universities has indicated they are "consulting with counsel about the Notice and its potential implications for existing law."
